Terms and Conditions
Version 2.2 | Prepared 02 May 2024
These terms cover use of www.jetmarbella.com and our services arranging private aircraft charters, empty legs and individual seats. Please read them and the booking documents before confirming or paying. We act as a booking agent; the licensed aircraft operator provides the flight. Sections 10 to 13 explain aircraft changes, cancellations and refunds.
The version supplied to you before you book applies to that booking. These terms do not retrospectively change existing bookings or repayment commitments. Mandatory passenger and consumer rights take priority throughout.
1 Who we are and how to contact us
1.1 JetMarbella and Jet Marbella are trading names of Super Fly Jets Limited, registered in England and Wales with company number 09503474. Our registered office is C/O Pollock Accounting, 3-4 Sentinel Square, London, England, NW4 2EL. In these terms, “we”, “us” and “our” mean that company trading as JetMarbella.
1.2 Contact us at admin@jetmarbella.com or +34 951 12 71 31. Formal correspondence may also be sent to our registered office. For urgent flight matters, use the operational contact provided with your booking; do not rely solely on email for a departure within 24 hours.
1.3 “You” means the person or company engaging us. A “consumer” is an individual acting wholly or mainly outside their trade, business, craft or profession. A “business customer” is any other customer. A “passenger” is a person travelling on a booked flight.
2 Our role and the flight contract
2.1 We provide aircraft charter brokerage and booking administration services. Unless a separate written agreement expressly states otherwise, you appoint us as your disclosed agent to source and arrange the flight with a licensed third-party aircraft operator (the “Operator”). We do not own or operate the aircraft and do not exercise operational control.
2.2 The contract for the flight is between you and the Operator (the “Flight Contract”). Our brokerage contract with you is separate. We will identify the Operator and provide its applicable carriage and charter terms before you authorise us to confirm the Flight Contract. Where the Operator is not yet identified, an indicative quote does not authorise us to enter into an undisclosed Flight Contract on your behalf.
2.3 You authorise us to conclude the Flight Contract on your behalf only after you have approved the relevant quote, Operator and booking terms. Additional charges and material changes require the approval described in these terms. Our appointment does not authorise us to waive your statutory rights or settle a claim without your express agreement.
2.4 Operator terms govern the Operator's performance of the flight. These terms govern our brokerage services, communications, payment administration and any express commitments we make. Neither set of terms removes mandatory legal rights. We remain responsible for performing our own services with reasonable care and skill.
2.5 Another group company or supplier is not a party to your brokerage contract simply because it uses a related brand. If a different contracting entity or legal capacity is proposed, we will disclose it before you book and obtain your agreement.
3 Booking documents and acceptance
3.1 Your booking documents comprise the accepted quotation, written booking confirmation, these terms, the Operator's terms and any expressly agreed special conditions. They should identify the route, dates, times and time zones, aircraft category or model, Operator, passenger capacity, price, payment deadlines, cancellation charges and material inclusions or exclusions.
3.2 Mandatory law takes priority. Within our brokerage contract, specific terms expressly agreed for your booking take priority over these general terms to the extent of a conflict. Operator terms do not override our separate express obligations to you. If documents conflict, we will clarify the position before confirmation.
3.3 A quote is subject to availability and any stated expiry. A flight is confirmed only when we issue written confirmation of Operator acceptance and the applicable payment requirements have been met or expressly waived in writing. A payment receipt alone is not confirmation that an aircraft is secured.
3.4 Acceptance may be by signature or a clear instruction by email, WhatsApp or another agreed electronic channel after the documents have been supplied. Payment can evidence acceptance only where the terms and the effect of payment have been clearly communicated beforehand. Mere website use does not constitute acceptance of a flight booking.
3.5 If you pay but we cannot confirm the booking, we will return the payment without deduction and initiate repayment within 14 calendar days, or sooner where law requires. We will not transfer it to an alternative flight without your approval.
3.6 Please check the confirmation promptly. Tell us immediately about an error. Failure to spot an error does not remove rights arising from our mistake. We may correct an obvious pricing error before acceptance; after acceptance, any correction requires a lawful basis and we will explain your options.
4 Lead passengers and representatives
4.1 The person booking must be at least 18 and have authority to act for the customer and provide instructions concerning the passengers. If booking for a company, you confirm authority to bind that company; you do not become personally liable solely by acting as its authorised representative.
4.2 The lead contact must provide accurate details, pass relevant flight information and terms to passengers, and obtain any authority needed to supply their information. We will identify an agreed decision-maker for changes and additional costs.
4.3 Chartering an entire aircraft does not permit resale of seats or sub-charter without prior written agreement and compliance with applicable aviation law. Individual seat bookings are subject to the expressly stated seat terms.
5 Prices and inclusions
5.1 The accepted quote states the currency, whether the price is per aircraft or per seat, the total payable and any taxes and fees known and calculable at that time. We will identify our brokerage fee or the basis of calculating it before you book, including where it is included in the total price.
5.2 Inclusions such as catering, baggage, pets, Wi-Fi, ground transport, lounges, passenger taxes, landing and handling charges are as stated in the quote. Images are illustrative unless we expressly confirm that a feature is included.
5.3 Potential additional costs may include de-icing, requested itinerary changes, airport extensions, extra handling, special catering, cleaning after damage or misconduct, and charges arising from passenger-caused delay. Their basis must be disclosed before booking where reasonably foreseeable. Additional charges must be lawful, reasonable, supported on request and not already included in the agreed price.
5.4 We will obtain your express approval before committing you to an optional extra or a replacement at a higher price. Where an Operator's proposed price increase or other material change is not accepted, your rights depend on the Flight Contract and mandatory law, including any right to cancel and obtain repayment. We will explain those rights before asking for a decision.
5.5 Necessary safety action remains under the captain's control. Where time permits we will seek instructions before incurring related charges. Safety action does not create an unrestricted right to impose undisclosed charges or remove statutory protections.
5.6 Currency conversion requires your agreement to the exchange rate or calculation basis and any lawful disclosed fee. We do not impose prohibited payment surcharges. Any permitted surcharge will be disclosed before payment and will not exceed the lawful amount.
6 Payment and handling of funds
6.1 Deposits and balances are due on the dates stated in your booking documents. A deposit is a part-payment, not automatically a non-refundable fee. Refundability depends on the reason for cancellation, the agreed lawful terms and your statutory rights.
6.2 We may receive flight payments as an authorised collection intermediary under the arrangements disclosed in your booking documents. Your confirmation will state the payment recipient and the capacity in which we receive and remit funds. We will accurately account for money received and payments made to the Operator.
6.3 Funds may need to be paid to the Operator before departure. We do not represent that money is held in escrow, on trust, in a protected client account or under an insolvency guarantee unless we expressly confirm the actual arrangement for your booking. This does not permit use inconsistent with our agency duties or applicable law.
6.4 We may require reasonable payer identification, authority and source-of-funds checks where legally necessary. We will explain any required information and handle it securely. A card may be charged only under the authority given; we will not collect the same payment twice.
6.5 If payment is late, we will contact you and give a reasonable opportunity to resolve it, having regard to departure time and the Operator's deadline. Where lawful, failure to pay may lead to release of the aircraft or client cancellation charges disclosed before booking. An Operator's immediate payment deadline will be highlighted before acceptance.
6.6 Verify any bank-detail change using a previously verified telephone number. Notify us immediately of suspected payment fraud. This request does not exclude our responsibility for our own security failures or negligence.
7 Passenger details and travel documents
7.1 Provide complete and accurate passenger names, passport or identity details, nationality, baggage, pet and assistance information reasonably needed for the flight by the stated deadline. We will explain the deadline and material consequences before booking where practicable, especially for short-notice flights.
7.2 Each passenger is responsible for valid passports, visas, entry and transit permissions and health documents. We can provide general administrative assistance but do not determine immigration eligibility. Any error or misinformation for which we are legally responsible remains our responsibility.
7.3 Late or changed passenger details may require security, border or Operator approval and may delay or prevent travel. We will assist reasonably and explain any supported additional charge. Refund consequences depend on the cause, actual costs, the Flight Contract and applicable law; refusal of carriage does not automatically make every payment non-refundable.
7.4 Tell us about assistance, mobility equipment, infants, medical needs or other requirements before confirmation where possible. We will seek Operator confirmation of arrangements and applicable lawful restrictions. Disability or a request for assistance does not itself justify refusal of service.
8 Baggage, pets and cabin arrangements
8.1 Baggage limits depend on aircraft hold dimensions, passenger numbers, fuel, weight and balance and route. Provide accurate baggage dimensions and weights when requested. An aircraft's maximum seat count does not guarantee capacity for every combination of passengers and baggage.
8.2 Pets require written Operator approval and appropriate documents. Disclose species, size and any crate requirement. Assistance animals are handled under applicable law. Any permitted cleaning or handling charge must be disclosed and agreed.
8.3 Dangerous goods, weapons, batteries and restricted items must meet applicable aviation rules and Operator requirements. Do not bring prohibited items. The captain may refuse unsafe baggage or loading, subject to applicable law.
8.4 Catering, connectivity and cabin amenities are those confirmed for the aircraft and flight. Tell us about allergies and dietary needs; we will relay them to the supplier and explain any inability to guarantee an allergen-free environment.
9 Flight information and passenger conduct
9.1 Your flight brief will identify the airport, terminal or FBO, reporting time, local departure time and operational contact. Airport codes and the written confirmation govern the booked location; ask us if an airport name is unclear. We will supply available information promptly and communicate material updates.
9.2 Passengers must arrive by the stated reporting time, monitor the agreed contact channel and follow lawful safety, security and crew instructions. Inform us urgently if you expect to be late. Any accommodation of a late arrival is subject to crew duty, slots, permits and availability.
9.3 The Operator and captain control flight safety, airworthiness, payload, routing and landing decisions. They may delay, divert or refuse carriage for lawful safety or security reasons. They must still comply with applicable passenger protections.
9.4 Passengers must behave lawfully and safely. No smoking or vaping unless expressly permitted by the Operator and law. A customer is liable for damage or reasonable documented costs caused by their own breach or by persons for whom they are legally responsible, to the extent permitted by law. No unlimited indemnity for unrelated third-party conduct is imposed.
10 Empty legs and individual seats
10.1 Empty legs depend on an underlying positioning requirement or principal flight and have an increased risk of change or cancellation. We will identify an empty-leg booking as such before payment. Changes to the principal itinerary can remove the positioning need.
10.2 The offer must state whether it covers the whole aircraft or specified seats, the agreed timing flexibility, route, passenger capacity and any special conditions. Unconfirmed advertisements are not a guarantee of operation.
10.3 If the Operator cancels an empty leg and no alternative acceptable to you is agreed, all amounts paid for the unperformed booking, including our brokerage fee, are refundable under section 12. You need not accept credit instead of money.
10.4 We recommend flexible arrangements for onward travel, accommodation and return journeys, particularly for empty legs. This recommendation does not remove rights to assistance, rerouting, reimbursement or damages where legally due.
10.5 Seat changes or transfers require prior approval and compliance with passenger-information requirements. There is no guaranteed right to resell or substitute a passenger, but we will consider reasonable requests and explain lawful charges.
11 Operator changes, aircraft failure and AOG
11.1 We will notify you promptly when informed of a cancellation, material delay or change. An aircraft being grounded or unserviceable (“AOG”) may prevent operation. Technical failure is not automatically treated as force majeure or as removing passenger rights.
11.2 If the booked aircraft becomes unavailable, we will use reasonable care and reasonable endeavours to source a suitable alternative. Availability and the original price cannot be guaranteed unless we have expressly sold a separate guarantee. We will explain available alternatives, their price and material differences.
11.3 Suitability will take account of your stated travel purpose, departure and arrival times, airports, passenger numbers, baggage, pets, accessibility and aircraft capability. A materially different aircraft or Operator requires your agreement. A registration change within an expressly agreed interchangeable aircraft category is not necessarily a material change, but we will communicate it where practicable.
11.4 We will obtain express approval before confirming extra cost. You are not required to pay more or accept a materially unsuitable alternative. We will not impose an arbitrary waiting period for replacement searches; a reasonable decision period depends on the urgency and travel requirements.
11.5 If the Operator cannot perform and no acceptable replacement is agreed within that reasonable period, you may elect a refund under section 12. Once we confirm we cannot fulfil the booking, your obtaining travel elsewhere is not a client cancellation and does not trigger client cancellation charges. Any statutory right to obtain alternative transport or recover its cost is preserved.
11.6 For a material change not amounting to complete cancellation, we will explain the choices available under the Flight Contract and applicable law. An agreed comparable operational substitution does not itself create an automatic cancellation right, but mandatory rights and any express booking promise take priority.
12 Refund entitlement, recovery and processing
12.1 Where the Operator cancels or cannot provide the agreed flight, or makes a material change entitling you to reject it, and no acceptable alternative is agreed, all amounts paid for the unperformed flight are refundable, including our brokerage fee. No cancellation penalty applies to that election. For a partly performed itinerary, repayment will reflect the unperformed services and applicable legal rights; an arbitrary flight-hour allocation will not override those rights.
12.2 We will acknowledge a refund request within five business days and confirm the amount, the basis of entitlement, funds still held by us and any amount paid to the Operator. “Business day” means Monday to Friday excluding public holidays in England. Mandatory periods stated in calendar days are not converted to business days.
12.3 We will promptly request repayment of refundable funds paid to the Operator on your behalf and diligently pursue recovery. Subject to lawful confidentiality and privacy restrictions, we will provide reasonable confirmation of the payment and recovery position on request.
12.4 Where we act solely as your disclosed agent and have properly remitted funds to the Operator on your behalf under the agreed Flight Contract, our obligation to pay you the Operator-funded portion from our own resources before recovery is limited to the extent permitted by applicable law. Unless law or an express undertaking requires otherwise, we do not guarantee the Operator's solvency or advance unrecovered Operator funds. Your claim to repayment against the Operator remains intact.
12.5 Section 12.4 does not delay any payment we ourselves owe by law or express promise. It does not apply to our own refundable fee, money still held by us and available for repayment, unauthorised payments, our breach of duty, negligence or mishandling of funds. It does not postpone an Operator's statutory reimbursement deadline or restrict your direct claims, payment-provider remedies or access to legal redress.
12.6 We will initiate repayment of refundable money remaining with us, including our refundable brokerage fee, within 14 calendar days of the refund election or confirmation that the money is refundable, whichever establishes entitlement. Where refundable money has been paid to the Operator, that portion becomes payable to you once it is recovered from the Operator, and we will pass it on within 14 calendar days of receipt. We will pass on partial recoveries without waiting for the full balance. Every period in this clause is subject to any shorter legal deadline.
12.7 While recovery remains outstanding, we will update you at least every 14 calendar days, even if there is no material progress. After 60 calendar days we will provide a written escalation update identifying the amount outstanding, action taken and available next steps. This is an escalation milestone, not a grace period or extension of any due date. We will not require you to wait for it before exercising your rights.
12.8 Refunds normally go to the original payer through the original payment method. If this is unavailable, we will agree a lawful verified alternative without unnecessary delay. We will provide payment confirmation when initiated. Bank or card posting time is separate from our processing time and does not excuse a failure to initiate payment when due.
12.9 We will not deduct processing, administrative or recovery charges from a full refund under section 12.1. A credit, voucher or replacement booking is optional and requires your express agreement. We will not make an undisputed refund conditional on accepting new terms, confidentiality or a waiver of unrelated rights.
12.10 If an Operator becomes insolvent, we will explain funds still held, sums paid away, recovery options and any actual protection applying to your booking. Recovery may be uncertain. This does not excuse our own obligations or any express guarantee. We will not describe unprotected funds as insured or guaranteed.
13 Changes or cancellation requested by you
13.1 Notify us promptly in writing if you wish to change or cancel. For urgent requests, also telephone your operational contact. We will acknowledge receipt. The actual receipt time governs notice; we do not automatically defer a received notice to the next business day when doing so increases charges.
13.2 Client cancellation charges and deadlines will be stated in your booking confirmation and the Operator terms supplied before acceptance. They can increase close to departure and may reach 100% where lawful and justified. There is no automatic cancellation scale incorporated merely by these general terms.
13.3 For consumers, charges must be fair and reflect legally recoverable losses. We and the Operator must take any mitigation steps required by law, including accounting for relevant savings, resale and recoveries. We will provide a reasonable explanation of charges on request. A label such as “non-refundable” does not override consumer rights.
13.4 Any separate cancellation or administration fee charged by us must have been disclosed and agreed before booking, must not duplicate another recovery and must be lawful and reasonable. Refunds after client cancellation will be administered under the applicable provisions of section 12, subject to lawful deductions and mandatory deadlines.
13.5 Missing a flight, failing to provide required documents or electing not to travel may attract the applicable lawful cancellation charges. Where the cause is Operator cancellation, our breach or a legally qualifying material change, it will not be reclassified as client cancellation merely because you do not travel.
13.6 Passenger transport bookings generally do not carry an automatic 14-day online cooling-off right. Any separate cancellation right applying to our brokerage service remains available. Where such a right applies, we will provide the required information and cancellation method before you engage us. We will seek your express request before starting that service during the cancellation period and any acknowledgement required before the right can end on full performance. Payment or acceptance of these general terms alone is not that request or acknowledgement.
13.7 Where the statutory 14-day right applies to the separate brokerage service, the period ends 14 days after the day that contract is entered into, subject to any legal extension for missing information. To cancel, send an unequivocal statement to admin@jetmarbella.com or our registered office before the period expires. You may use: “I give notice that I cancel my brokerage services contract with Super Fly Jets Limited trading as JetMarbella. Booking reference: ____. Contract date: ____. Customer name and address: ____. Date: ____.” A signature is needed only for a notice sent on paper. Using this form is optional.
13.8 If you validly cancel that separate service under the statutory cooling-off right, we will refund the brokerage-service payment without undue delay and within 14 days of being informed, using the original payment method unless otherwise agreed, without a refund fee. Where you expressly requested early performance and the required information was provided, a lawful proportionate amount for services actually supplied before cancellation may be payable. Cancelling the separate brokerage service does not automatically cancel an already authorised Flight Contract or create a cooling-off right for passenger transport.
13.9 Where permitted by law, the separate service cancellation right ends only when all agreed brokerage services have been fully performed after the required express request and acknowledgement. We will not treat the entire ongoing service as fully performed merely because an initial quote or flight confirmation has been sent.
14 Passenger rights and disrupted travel
14.1 Depending on the route and circumstances, EU Regulation 261/2004, its UK equivalent, the Montreal Convention or other mandatory rules may apply to the Operator or another legally responsible party. Private charter or empty-leg status does not itself exclude mandatory passenger rights.
14.2 Rights may include reimbursement, rerouting, care and assistance, compensation and remedies for baggage or delay. Their availability depends on the applicable rules. We will provide the Operator's contact details and reasonably assist with claims, without representing that every claim must go through us.
14.3 Any applicable seven-day carrier reimbursement obligation is not replaced by our refund processing provisions or by waiting for Operator repayment. Compensation is distinct from repayment of the flight price. A technical problem does not automatically eliminate either right.
14.4 You do not have to waive passenger rights to receive an undisputed refund. There can be no double recovery of the same loss, but payment of a refund does not itself settle a separate valid claim for additional loss or compensation.
15 Events beyond reasonable control
15.1 Severe weather, airspace closures, war, security threats, government restrictions, airport closure or other events outside reasonable control may affect a flight. We will inform you when aware, take reasonable steps within our role to reduce disruption and explain available options.
15.2 Such an event excuses performance only to the extent and for the period permitted by the contract and applicable law. It does not automatically forfeit your payments or remove refund, rerouting, assistance or other mandatory obligations. Lack of available operating funds alone does not excuse an amount we are legally required to pay.
16 Insurance and financial protection
16.1 Flights are operated under the Operator's applicable insurance arrangements. Ask us for available Operator insurance information if needed. We do not guarantee that every passenger loss is covered by that insurance.
16.2 We recommend suitable travel insurance, including disruption, medical, baggage and cancellation cover, and checking whether private charter and empty legs are included. Insurance is not a substitute for our or the Operator's legal duties.
16.3 No ATOL, package protection, escrow, insolvency insurance or flight replacement guarantee is represented by these terms. Where a booking benefits from a specific scheme, we will identify the provider, scope, limits and required documents before payment. We will provide any protection required by law.
17 Our responsibility to consumers
17.1 We are responsible for loss and damage you suffer as a foreseeable result of our breach of the brokerage contract or our failure to use reasonable care and skill. Loss is foreseeable if it is an obvious consequence or was contemplated when contracting, including because you told us about relevant circumstances.
17.2 The Operator is responsible for its flight obligations. Our agency role does not remove liability we independently incur through our conduct, representations, payment handling or an express commitment. These terms do not make us a guarantor of the Operator beyond obligations imposed by law or expressly assumed by us.
17.3 We do not exclude liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, breach of mandatory consumer rights, or any other liability that cannot lawfully be limited. No general fee-based cap applies to consumer claims under these terms.
17.4 We are not responsible for losses attributable solely to your breach, to the extent permitted by law. You must take reasonable steps to reduce recoverable losses. We will not characterise all replacement travel costs as excluded “consequential losses”; entitlement depends on the facts, contract and law.
18 Business customers
18.1 This section applies only to business customers. Subject to section 18.3, our total liability arising from our brokerage services for a booking, in contract, tort or otherwise, is limited to the total Charter Price agreed for that booking. This cap does not reduce money held for you or an express obligation to repay refundable booking funds.
18.2 Subject to section 18.3, we are not liable to a business customer for indirect or consequential loss or loss of profit, revenue, business opportunity or goodwill. This does not exclude a direct claim expressly covered by a separate written guarantee.
18.3 No limitation applies where prohibited by law, including death or personal injury caused by negligence, fraud or fraudulent misrepresentation. All exclusions and caps are subject to applicable legal requirements, including reasonableness. Statutory passenger rights are preserved regardless of who pays for the booking.
19 Other travel services and packages
19.1 Ground transfers, accommodation and other services are included only if expressly booked. We will identify the supplier, our role, applicable terms and price before acceptance. A website link or suggestion alone does not confirm a reservation.
19.2 These terms address standalone charter brokerage and website use. If a combination constitutes a package or linked travel arrangement, applicable statutory obligations cannot be excluded by description. We will provide the required specific information, terms and financial protection before concluding such an arrangement. No customer should assume protection merely from a combination of quotations.
20 Personal information and privacy
20.1 We process information needed to arrange bookings, administer payments, communicate with you, comply with law and manage claims. We will provide a separate privacy notice explaining our legal bases, retention, international transfers and your data rights when collecting personal data.
20.2 Necessary information may be shared with Operators, handling agents, airports, border authorities, payment providers and other relevant suppliers. Provide only information reasonably needed and use a secure method for passports, payment details and sensitive information. Ask us for a secure submission route.
20.3 Booking acceptance is not consent to unrelated marketing. Marketing preferences and cookie choices are handled separately in accordance with applicable law. Contact admin@jetmarbella.com for privacy requests or the current privacy notice.
21 Website content and permitted use
21.1 We use reasonable care to keep website information useful and accurate, but quotes, availability, images and specifications can change. Rely on the agreed booking documents for the service purchased. Website disclaimers do not override an express promise or legally binding pre-contract information.
21.2 Website material and brand assets belong to us or our licensors. You may view and save information for legitimate enquiries and retain booking records. Reproduction for commercial use requires permission or another lawful basis. Do not unlawfully scrape, interfere with security, distribute malware, impersonate others or misuse enquiry systems.
21.3 We may reasonably restrict abusive or unlawful website use, but not to prevent access to booking records, complaints or refunds legitimately due. We do not guarantee uninterrupted website access. Third-party links are provided for convenience and their terms apply to their own services.
22 Compliance and lawful refusal
22.1 Bookings are subject to applicable sanctions, anti-money-laundering, aviation, security and border requirements. We may refuse or suspend an arrangement where legally required or where reasonably necessary to investigate a substantiated compliance concern. We will explain the position to the extent legally permitted.
22.2 A lawful restriction on repayment may require funds to be frozen or handled as an authority directs. We will not use compliance checks as a general reason to delay an otherwise lawful refund. Any lawful cancellation charges remain subject to the actual cause, agreed terms and mandatory rights.
23 Complaints and disputes
23.1 Send complaints to admin@jetmarbella.com with your booking reference, relevant facts and desired resolution. We aim to acknowledge complaints within two business days and give a substantive response within 14 calendar days. If more time is needed, we will explain why and provide an update date. Urgent flight and refund action will not await completion of the complaints process.
23.2 We will cooperate with reasonable efforts to resolve a dispute. Where required, we will provide details of an appropriate alternative dispute resolution body and state whether we are obliged or willing to participate. We do not claim membership of an arbitration, mediation or compensation scheme unless confirmed separately.
23.3 Nothing requires you to exhaust our complaints procedure before seeking urgent relief, contacting a regulator, exercising payment-provider rights or bringing a lawful claim. We will provide reasonable documents needed for a valid refund or passenger-rights claim.
24 Electronic communications and records
24.1 Writing includes email and expressly agreed electronic messages. Important terms, confirmations and changes will be supplied in a form you can save. A unilateral message does not amend an existing contract unless the change is legally effective and agreed where required.
24.2 Keep your contact details current and tell us promptly if a message is missing. We will take reasonable steps to communicate urgent changes and will not deem an unread message received simply to defeat your rights. Formal court documents must be served in accordance with applicable procedural law.
25 Changes to terms and general provisions
25.1 We may update these terms for future bookings. The version provided before acceptance continues to govern an existing booking unless a lawful change is expressly agreed. We will retain a record of the relevant version. Updating this website does not amend an existing refund obligation.
25.2 We may transfer our brokerage contract only where doing so does not materially reduce your rights or service and where permitted by law. We will notify you and provide any termination or consent right required by law. Appointment of an assistant or subcontractor does not remove our responsibility for our own services.
25.3 If a provision is unlawful or unenforceable, the remaining provisions continue where legally possible. Failure to enforce a right immediately is not a waiver. No term excludes liability for a statement that the law treats as binding.
25.4 Except as expressly agreed or required by law, a non-party has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce our brokerage contract. This does not restrict a passenger's independent statutory or carriage rights.
26 Governing law and courts
26.1 Our brokerage contract is governed by the law of England and Wales, subject to mandatory rules that apply notwithstanding that choice. A consumer retains any non-excludable protections of the law of their habitual residence where applicable.
26.2 The courts of England and Wales have non-exclusive jurisdiction. Consumers may also bring proceedings in any court available to them under mandatory jurisdiction rules, including their home courts where applicable. Nothing requires a consumer to litigate only in England or prevents recourse to a competent aviation or consumer authority.
26.3 The Flight Contract's governing law and jurisdiction will be identified in the Operator's terms. They do not remove mandatory passenger rights or change the parties responsible under applicable law.
